Президентът Румен Радев сезира Конституционния съд за промените в Закона за опазване на земеделските земи. Това съобщи прессекретариатът на държавния глава.
С обнародвания Закон за изменение и допълнение на Закона за енергията от възобновяеми източници – част от законите по Плана за възстановяване и устойчивост – народните представители въведоха и промени в Закона за опазване на земеделските земи, с които президентът не е съгласен, отбелязват от прессекретариата.
С премахването на почти всички ограничения пред поставянето на инсталации за производство на ВЕИ върху обработваема земя новите разпоредби създават риск от безконтролно превръщане на земеделски площи във всякакъв тип централи за производство на енергия. Допускането на строителство на съоръжения за вятърна, слънчева, водноелектрическа, геотермална или енергия от биомаса и биогорива, върху висококачествена земя (5-а категория), позволява промяна на предназначението на по-голямата част от земеделските земи и пасища в България.
Според президента това влиза в противоречие с разпоредбата на чл. 21 от Конституцията на Република България, според която земята е основно национално богатство, а обработваемата земя се използва само за земеделски нужди. Промяна на нейното предназначение се допуска единствено по изключение и при доказана нужда. Нито в мотивите, нито в разискванията по законопроекта такава необходимост не е обсъждана. Нещо повече, не са взети предвид възраженията на Министерството на земеделието и храните, а голяма част от спорните текстове са внесени между първо и второ четене, посочва прессекретариатът.
Поради това, отчитайки първостепенната важност на опазването на земеделските земи, президентът упражнява правомощието си да отнесе въпроса до Конституционния съд с искане за обявяване на противоконституционност на §78 от Закон за изменение и допълнение на Закона за енергията от възобновяеми източници.
